Indefinite leave to remain

You can make an application for Settlement to stay in the UK permanently under various grounds. If you are subject to immigration control but have lawfully lived in the UK for a certain length of time, you may be able to apply for permission to settle permanently.

 

Settlement: refugee or humanitarian protection

You can apply to settle in the UK (known as ‘indefinite leave to remain’) if you’ve got a residence card as a:

 

•   refugee

•   person with humanitarian protection

 

There is no fee for applying for settlement as a refugee or person who’s been given humanitarian protection.

 

The following can also apply for Settlement (ILR) after a period of time:

 

•   You're the family member or partner of a British citizen

•   You're the family member or partner of someone who has settled in the UK

•   You have a study visa

•   You have a work visa

•   You have a UK Ancestry visa

•   You have a Retired Person visa

•   You've been settled in the UK before

•   You have Discretionary Leave

•   You're in or have been in HM Forces

•   You're on the 10-year Private Life route

•   You've been in the UK legally for 10 years (Long Residence)

 

To make an application you must already be in the UK. Furthermore you must demonstrate that you have knowledge of language and life, although certain applicants are exempt from this requirement including children (under 18), parents, grandparents and other dependent relatives of people present and settled in the UK, or those resident in the UK as a refugee. You can demonstrate your knowledge of language and life by passing the Life in the UK test, and either having a recognised qualification in English, having a degree that was taught or researched in English or being a national of an English-speaking country.

 

If you do not yet qualify for ILR you may be able to extend your existing visa by applying for Further Leave to Remain. You must also apply to extend your stay before your existing permission expires which, if not done will mean you are an overstayer which will risk an order for enforced removal.
